A. Project Description The Muskingum River Parkway consists of Lock and Dams No. 2 through No. 11, which are regulated by the ODNR Dam Safety Program. These structures are part of a river navigation system that was constructed in the 1840s. Many of these structures have unique historical characteristics which have been maintained since their original construction. Design-build services are being requested for the dam replacement and lock rehabilitation at McConnelsville Lock and Dam No. 7. The project is located on the Muskingum River Parkway owned by the Ohio Department of Natural Resources in Morgan County. The dam, constructed in 1841 and reconstructed in 1959, is approximately 14 feet in height and 472 feet wide and regulated by the ODNR Dam Safety Program as a Class II structure. It is a cellular sheet pile structure, filled with sand and gravel capped with concrete. The dam is in poor condition and in need of replacement. The lock is located at the downstream end of the canal, approximately 0.2 miles downstream of the dam. The lock is approximately 26 feet wide with sandstone masonry lock walls approximately 229 feet in length and up to 30 feet in height. As funding allows, rehabilitation of the lock walls, downstream valves, and other improvements will be considered. The Concept and Design Criteria Documents will be developed as a part of this project by the Criteria Architect/Engineer (“Criteria A/E”). Construction will be undertaken to ensure public safety and long-term performance as well as functional and aesthetic improvements. The site of the proposed work is located at McConnelsville Lock and Dam No. 7 and includes full dam replacement and may also include lock improvements. All work shall be performed in compliance with all applicable regulatory requirements including ODNR dam safety and USACE/OEPA 401/404 permitting processes. All aspects of the project and related issues will be implemented and operated consistent with the Contracting Authority and/or Owner’s policies and procedures. B. Scope of Services The selected Design-Builder (DB) firm shall use recently completed detailed analyses and the design criteria developed by the Criteria A/E to design and perform the improvements at McConnelsville Lock and Dam No. 7 to help bring the dam into compliance with Ohio dam safety laws and rules. These improvements may include a replacement of the existing dam, abutment rehabilitation, lock rehabilitation, and valve replacement. Preliminary assessment of the system has been completed, including recommended alternative remedial measures. Pursuant to ORC 153.694, professional design firms selected to provide C-A/E services shall not provide any A/E of Record services for the project for which the professional design firm was selected as the C-A/E. As required by the Agreement, and as properly authorized, provide the following categories of services: develop and maintain estimates of probable construction cost, value engineering, project schedules, and construction schedules; lead and manage the Study and Report Verification, Preliminary Design, 50% Design, 90% Design, GMP Proposal and Request for Qualifications (Design-Build Contract) continued F180-01-2015-MAY Publish Date: 10/07/2019; Ohio Register # 314 Page 2 of 5 Amendment, 100% Design, Subcontractor Prequalification and Bidding process, Construction Documents, Construction and Closeout stages. Refer to the Ohio Facilities Construction Manual additional information about the type and extent of services required for each. A copy of the standard Agreement can be obtained at the OFCC website at http://ofcc.ohio.gov. The preconstruction and construction services are generally described below. Subcontracts will be awarded by the Design-Builder (“DB”) to prequalified vendors using a competitive process. The parties will engage in an "open book" pricing method in which all subcontracted work shall be based upon competitive pricing that will be reviewed by the Contracting Authority and the Owner, the Criteria A/E and the DB. The Contracting Authority and/or Owner shall have access to all books, records, documents and other data in the DB's possession related to itself, its subcontractors and material suppliers pertaining to bidding, pricing or performance of the Agreement. Preconstruction Services: The DB will work cooperatively with the Contracting Authority and/or Owner, Criteria A/E and Project Team, and will provide, among other services, schedule development, estimate development, preliminary design, 50% design, 90% design, and 100% design, Guaranteed Maximum Price (GMP) proposal, subcontractor prequalification and bidding, construction documents preparation, constructability review, permits, budgeting, value engineering, and preconstruction planning throughout the preconstruction stages. When the drawings and specifications are at a stage of completion specified in the Agreement, such partially completed documents (the "Basis Documents") shall be provided to the DB, together with the Architect/Engineer of Record’s (“AOR”) detailed listing of any incomplete design elements and the AOR’s statement of intended scope with respect to such incomplete elements (the "Design Intent Statement"). Contingent upon the Contracting Authority’s approval of the GMP, the parties will enter into an amendment to the Agreement establishing the Contract Sum (“GMP Amendment”). If the proposed Contract Sum exceeds the Project Budget established for construction, then the Contracting Authority may terminate the agreement with the DB and seek proposals from other firms for completion of the Project. Construction Services: The DB shall construct the Project pursuant to the construction documents and in accordance with the schedule requirements. The DB shall hold all subcontracts and shall be fully responsible for the means and methods of construction, weekly progress meetings, testing and inspections, project safety, project completion within the schedule agreed upon in the preconstruction phase, compliance with all applicable laws and regulations including monitoring compliance with all EDGE, equal employment, and prevailing wage requirements, and submitting monthly reports of these activities to the Contracting Authority. All subcontracts shall be on the subcontract form prescribed by OAC Section 153:1- 03-02. The Contracting Authority reserves the right to approve the DB’s selection of subcontractors and any supplemental terms to the subcontract form. For purposes of completing the Relevant Project Experience Matrix in Section F of the Statement of Qualifications (Form F110-330), below is a list of relevant scope of work requirements for this RFQ: 1. Experience with the design-build delivery method as a Design-Builder. 2. Experience with design of dam and canal related projects, including innovative design alternatives, for low head dams, locks, and gates with a focus on lock structures, cofferdams, and development of dewatering plans. 3. Experience in construction administration for dam rehabilitation projects. 4. Experience with hydrologic, hydraulic and flood routing analyses. 5. Experience in structural, geotechnical, seepage, and stability analyses. 6. Knowledge of Ohio Dam Safety Laws and Rules and familiarity with regulatory and permitting agencies having authority over dam and water resources related projects. 7. Direct experience with historic structures, regulatory permitting, and associated mitigation of any impacts. 8. Experience in developing and maintaining a quality control testing program for dam construction projects. 9. Experience working under a contractual relationship for state and/or other governmental agencies. 10. Experience with stakeholder communications and public information associated with large heavy civil projects. C.
