NOTICE OF VIEWING AND FINAL HEARING

PROPOSED VACATION OF A PORTION OF AN UNNAMED ALLEY
SITUATED IN MIAMI TOWNSHIP, CLERMONT COUNTY, OHIO

The Board of County Commissioners of Clermont County, Ohio, pursuant to the authority vested in the Board by Section 5553.04 of the Ohio Revised Code, will consider the proposed vacation of a portion of an unnamed alley situated in Miami Township, Clermont County, Ohio, and in Robert Todd’s Military Survey No. 1017 of the Virginia Military Surveys, and being more particularly described as follows:

Vacation North

Situated in the state of Ohio, Clermont County, Miami Township, Village of Miamisville, in Robert Todd’s Military Survey No. 1017 of the Virginia Military Surveys, being an alley as designated on the plat of Miamisville, Plat Book “B,” Page 132 of the Plat Records of Clermont County and being more particularly described as follows:

Commencing at a Mag Nail found in the intersection of State Route No. 126 and Main Street, thence, with said Main Street, south 12° 25’ 33” east, 26.85 feet; thence, leaving said Main Street, south 77° 34’ 27” west, 28.98 feet to a 5/8” metal pipe set in the south right of way for State Route No. 126 and the west right of way for Main Street, said point being the northeast corner of Lot 5, the Addition to Miamisville, there being two (2) lot 5 on said plat, thence, with said west right of way for Main Street, south 12° 21’ 33” east, 100.00 feet to the south east corner of Lot 6, the north limits of said Un-Named / Un-Developed Alley and the beginning; thence, continuing in the direction of said west right of way for Main Street, south 12° 21’ 33” east, 7.50 feet to a 5/8” metal pipe set and the middle of the Un-Named / Un-Developed Alley; thence, with said middle of said alley, south 77° 38’ 27” west, 100.00 feet to a 5/8” metal pipe set in the line of the east right of way for Drake Alley; thence, with said east line of said Drake Alley, north 12° 21’ 33” west, 7.50 feet to the south west corner of said Lot 6 and the northern limits of the right of way for said Un-Named / Un-Developed Alley; thence, with said southern limits of Lot 6 and north limits of said alley, north 77° 38’ 27” east, 100.00 feet to the beginning, containing 0.017 acres of land more or less, subject to all easements of record.

Bearings in the above description are based on grid north, the Ohio Coordinate System, South Zone, observations taken on May 16, 2022 and June 2, 2022, with a Topcon GRS-1 using Magnet software and the Ohio D.O.T. Cors system and all monuments called for are in good condition.

Vacation South

Situated in the state of Ohio, Clermont County, Miami Township, Village of Miamisville, in Robert Todd’s Military Survey No. 1017 of the Virginia Military Surveys, being an alley as designated on the plat of Miamisville, Plat Book “B,” Page 132 of the Plat Records of Clermont County and being more particularly described as follows:

The Final Hearing on the proposed vacation of a portion of an unnamed alley situated in Miami Township as described will be held on Wednesday, July 12, 2023, at 11:00 A.M. Local Time in the office of the Board of County Commissioners, 101 East Main Street, Batavia, Ohio 45103, to receive comments.
